Terms of Service for Foundation Repair And Waterproofing

[Hunter and Son Construction, Inc.] (“Company,” “we,” “us,” or “our”) provides foundation repair, concrete leveling, and related services. By signing an estimate, proposal, or contract with us, you (“Customer” or “Owner”) agree to the following terms:

1. Scope of Work and Site Conditions

\n1.1. Specific Services: The Company agrees to perform the services detailed in the written proposal/estimate. Any changes or additions to the work will require a written Change Order signed by both parties.
\n1.2. Site Access and Preparation: The Owner is responsible for clearing the work area, including moving furniture, plants, landscaping, and personal items.
\n1.3. Hidden Conditions: The Company is not responsible for damage to, or locating, underground utilities (sewer, water, gas, electrical, sprinkler) not marked by public utility locators. Damage to undisclosed, improperly buried, or shallow lines is the responsibility of the Owner.
\n1.4. Structural Variation: The location of piers or supports may vary based on structural, plumbing, or underground obstructions encountered during work.

2. Payment Terms

\n2.1. Invoicing: Payments are due according to the schedule in the proposal (e.g., Deposit, Mid-point, Final Completion).
\n2.2. Late Payments: A 10% late fee (or maximum allowed by state law) may be applied to overdue invoices.
\n2.3. Collection Costs: The Owner agrees to pay all attorney fees and collection costs incurred by the Company to collect unpaid balances.

3. Warranty and Liability Limitations

\n3.1. Workmanship Warranty: The Company warrants the workmanship of the installation for a period defined in the written agreement. This warranty covers the repair areas only.
\n3.2. Exclusions: The warranty does not cover:
Damages caused by abuse, neglect, or lack of proper maintenance (e.g., poor drainage).
Damages from plumbing leaks or acts of God (floods, earthquakes).
Cosmetic cracks in drywall, plaster, or brick that may occur during or after the lifting process.
\n3.3. Post-Repair Care: The Company recommends waiting at least 45 days after foundation work before repairing drywall or cosmetic damage to allow the structure to settle.
\n3.4. Limitation of Liability: To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages resulting from our services.

4. Safety and Site Compliance

\n4.1. Safety Protocols: The Owner agrees to keep children and pets away from the work area during operations.
\n4.2. Damages: The Company is not responsible for damage to underground pipes, cables, or wiring that are not installed to code or are not clearly marked.

5. Termination

\n5.1. Termination by Company: The Company reserves the right to terminate this agreement if the owner breaches these terms, such as failure to pay, or if site conditions are unsafe.

6. Governing Law

\n6.1. Jurisdiction: These terms shall be governed by and construed in accordance with the laws of the State of [Kansas].
